The famed Arrows Restaurant of Maine is planning a second location in Portsmouth on Middle Street. The chef/owners Clark Frasier and Mark Gaier were nominated by the James Beard Foundation as Best Chefs of the Northeast in March, 2004. National press has listed them as one of the top 50 restaurants of America by Gourmet magazine. The restaurant plans an open kitchen-dining area that would seat about 150 people. Retailer Attrezzi of Portsmouth is taking Maytag Corporation of Newton, Iowa, to court over the use of the same name, Attrezzi, by Maytag’s Jenn-Air unit on a line of small kitchen appliances. The lawsuit alleges that since Attrezzi first began using the trademark ATTREZZI in June, 2002, it has spent significant time and money promoting the name to customers in New Hampshire, Maine and Massachusetts, and also to customers nationwide on its Web site, www.attrezzinh.com .

Maytag claims there wouldn’t be any confusion in the marketplace, but Jennifer Slade says, “I really don’t see how they can take that position when we have shown Maytag and the court
several e-mails from confused consumers, including one Maytag customer who sent an angry e-mail to us because she hadn’t received a product she had ordered months ago from Maytag. Well, good luck to David in this David and Goliath lawsuit. One thing though, the Jenn-Air Attrezzi line is a beautifully-designed example of the new trend toward “counterscaping.” NH
